JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 399, 400, 402, 411, 413, 414 of the Indian Penal Code and u/s 25(1-B)a, 26, 35 of Arms Act.

As per the prosecution case, on secret information that some miscreants have gathered at Semra Ghat a raid was conducted and three accused persons were arrested, who disclosed the name of petitioner as one of his associates. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the possession of the petitioner. It is stated in paragraph 3 of the

Patna High Court CR. MISC. No.48557 of 2021(2) dt.23-11-2021 2/2 petition that although petitioner is accused in nine other cases but he was first arrested in Bettiah Muffasil PS case No. 756/2020 and subsequently remanded in all other cases of the year 2020. Petitioner is in custody since 25.03.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in connection with Majhaulia PS case No. 435/2020.
