2. The petitioner is in custody in a case registered for the offence punishable under Sections 406, 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code and Sections 66, 66(C) (D) (F) of the Information Technology Act.

3. As per allegation in the FIR, it is a case of cyber crime and recovered two mobiles, two ATM Cards, cash of Rs.3700/- and other articles.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. He further submits that on the basis of suspicion and due to his criminal antecedent petitioner has been falsely been implicated in this case. It is also submitted that alleged Sections are not made out against the petitioner and there is no allegation of cheating to any

One co-accused person, namely, Pankaj Bind @ Pankaj Kumar has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 79491 of 2023 vide order dated 29.02.2024 and one another co-accused, namely, Santosh Kumar @ Santosh whose bail was already rejected by this Court on 28.02.2024 and thereafter The Hon'ble Apex Court has granted bail to the said accused vide order dated 22.07.2024 passed in Cr. Appeal No. 3011 of 2024 (arising out of S.L.P. (Criminal) No. 6648 of 2024). He next submits that the petitioner is in custody since 24.06.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering facts and circumstances of the case and submissions made by the learned counsel for the petitioner, let the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in Lakhisarai Cyber P.S. Case No. 01 of 2023.
