1. Heard learned Senior counsel for the petitioner, Mr. Rama Kant Sharma, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.

2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126, 115(2), 103(1), 303(2), 352 and 351(2) of the BNS, 2023.

Learned Senior counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and the informant alleges that accused persons including the petitioner assaulted his brother with an iron rod on account of which he died, further the occurrence was committed at the behest of Mahendra and Vijay and petitioner along with Tetri

4. Learned Senior counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in the instant case with an intent to coerce the male members into submission. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioner, rather the informant alleges that Tetri along with this petitioner had snatched the chain of the deceased. It is next submitted that Tetri Devi had moved this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 25912 of 2026 and the same came to be allowed by an order dated 24.04.2026 passed by a learned Co-ordinate Bench. It is further submitted that case of the petitioner is similar to the case of Tetri Devi, thus, based on parity, anticipatory bail is sought.

Learned A.P.P. for the State as well as the learned counsel appearing on behalf of the informant opposes the anticipatory bail application of the petitioner, but then are not in a position to rebut the submission of the learned Senior counsel appearing on behalf of the petitioner that allegation of assault is not specific, petitioner is a woman with clean antecedent and Tetri Devi has been granted the privilege of anticipatory bail.

Considering the submissions made by the learned Senior counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Wazirganj P.S. Case No. 489 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. Accordingly, the instant anticipatory bail application stands allowed.
