2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126 (2), 115 (2), 298, 303 (2), 117 (2), 351, 352 and 3 (5) of the Bharatiya Nyaya Sanhita, 2023 and Section 37 of the Bihar Prohibition and Excise Act.
3. The allegation in the first information report is that four named and three to four unknown miscreants including the petitioner are said to have entered into a temple in inebriated condition and damaged the idol of Lord Shankar and threatened the villagers of dire consequences. It is further alleged that the informant is one of the persons who intervened and was assaulted by iron rod and lathi owing to which he suspects that

4. It is submitted by learned counsel for the petitioner that there is general and omnibus allegation in the first information report with regard to damaging the temple and assault upon the informant. No such occurrence as alleged ever took place. The specific allegation with regard to the petitioner is only that he snatched the chain from the informant. It is further submitted that the petitioner has also filed a case against the wife of the present informant under SC/ST Act. The injury upon the informant, as would be evident from the bail rejection order, seems to be serious in nature. However, it is submitted that the said injury was on the finger of the informant as stated in the first informant report. The petitioner has no criminal antecedent and has been languishing in custody since 16.03.2025.
5. Learned APP for the State and learned counsel for the informant vehemently opposed the bail petition.
6. Taking into consideration the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below

Case No.235 of 2025, subject to the condition that the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
