The petitioner seeks bail in connection with Sahodara P. S. Case No.32 of 2021, instituted for the offences under Section 414 of the Indian Penal Code read with Section 30(i) and 30(ii) of the Ancient Monuments, Archaeological Sites and Remains Act, 1958.

The learned counsel for the petitioner submits that the petitioner is in custody since 27.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of a statue of Lord Budha from the house of Mohit Kumar and the petitioner was apprehended on suspicion while he was passing through the

The learned counsel for the petitioner submits that no case has been instituted with regard to stealing of the statue of Lord Budha and as such, it cannot be said that it was a stolen idol.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 27.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Bettiah, West Champaran in connection with Sahodara P. S. Case No.32 of 2021.

The application stands allowed.
