JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 342, 328, 307, 506 and 34 of the Indian Penal Code.

Prosecution case is that on 28.11.2015, the son of the informant namely Ravi Ranjan Kumar went to meet with one Pramod Kumar Bhagat when co-accused Abhinandan Prasad Thakur, Pramod Kumar Bhagat and the petitioner Amresh Kumar put some sedative material in his nose and took him on a motorcycle. Subsequently, on search son of the informant was found in unconscious condition in a field. It is further alleged that earlier daughter of the informant was abducted and killed by coaccused Abhinandan Prasad Thakur and all the accused persons used to give threatening to the informant's side to compromise the

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and the son of the informant is a drug addict. There is no medical report on record to suggest the accusation levelled in the FIR. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM (West), Muzaffarpur in connection with Motipur P.S. Case No.15/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
