JUSTICE ANIL KUMAR SINHA ORAL ORDER 28-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Pirbahore P.S. Case No. 210 of 2021 registered for the offences punishable under Sections 341, 323, 307 and 504 of the Indian Penal Code 1860.

The allegation, as per the First Information Report, is that the petitioner allegedly assaulted the informant by means of hard iron object, due to which, the informant sustained injury on his head.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and there was a scuffle between the petitioner and the informant on the point of

He further submits that the injury caused to the informant is not serious in nature which would be evident from the injury report attached with the case diary in which the Doctor has opined the injury on the head as normal in nature. Petitioner is in custody since 27.5.2021 and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the injury caused to the informant is not serious in nature, the petitioner has got no criminal antecedent, he is in custody since 27.5.2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S.
