JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner and the State. The petitioners apprehend their arrest in connection with Lodipur P.S. Case No.85 of 2011 under sections 147, 148, 149, 341, 323, 387, 504, 307, 379 of the Indian Penal Code and section 27 of the Arms Act.
Learned counsel for the petitioners submits that the allegation of firing is against accused Pappu Yadav and the allegation of snatching gold chain is against accused Public Yadav and they have been enlarged bail by this Court by order dated 27.3.2012 passed in Criminal Misc. No.8742 of 2012. The case of the petitioners is on better footing than those of accused Pappu Yadav and Public Yadav.
Considering the facts and circumstances of the case, the
Patna High Court Cr.Misc. No.35892 of 2014 (2) dt.20-02-2015 petitioners namely, Chandan Yadav, Bhawesh Yadav, Photo Yadav @ Amit Yadav, Sunny Kumar @ Sanni Kumar Yadav and Rajesh Yadav are directed to be released on anticipatory bail, in the event of their arrest/surrender, in connection with Lodipur P.S. Case No.85 of 2011 on furnishing bail bonds of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Bhagalpur.
