JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 447,341,323,379,511 and 307/34 of the Indian Penal Code. The prosecution case is that petitioner no. 2 entered into the house of the informant and took away box. On alarm being raised by Asha Devi the accused persons came and assaulted Asha Devi and her husband. It is alleged that petitioners assaulted Raj Kumar Yadav by iron rod. Co accused Kaushalya Devi took away gold ring and chain.
It is submitted by the learned counsel for the petitioners that the accusation of assault is levelled against seven accused persons including the petitioners but both Asha Devi and her husband received one simple injury. There is counter version of
Patna High Court Cr.Misc. No.16890 of 2016 (2) dt.21-04-2016 2/2 the occurrence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Mufassil P.S. Case No.455 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
