Khare, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Sursand P.S. Case No. 138 of 2020 instituted for the offences under Sections 379, 411/34 of the Indian Penal Code.

The tractor of the informant was found to be stolen. Later, it was found parked near the house of one Ramshrestha Rai but one person was found opening the parts of the tractor. Seeing the police party, the aforesaid person is said to have run away. However, he was caught by the police party, who disclosed his name as Shravan Kumar.

No.35396 of 2020(2) dt.24-03-2021 2/3 The name of the petitioner has transpired in the statement of aforesaid Shravan Kumar that the vehicle was stolen by all the accused persons including the petitioner. Learned counsel for the petitioner has submitted that though he has been named in the F.I.R. but only on the statement of an arrested suspected accused person, namely, Shravan Kumar. It has further been submitted that there is a reason for falsely implicating the petitioner as he had some dispute with the informant in the past with respect to delivery of Gas Cylinder.

The petitioner does not have criminal antecedents.

Considering the afore-stated facts, the petitioner, above named, is directed to be released bail on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum SDJM, Pupri at Sitamarhi, in
