This is the second attempt of the petitioner seeking bail as earlier the bail application of the petitioner was rejected vide order dated 03.01.2022 in Cr. Misc. No. 28432 of 2021. Learned counsel for the petitioner submits that one of the co-accused Raja Kumar recently has been granted bail vide order dated 06.04.2022 in Cr. Misc. No. 12132 of 2022. Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that the accused Raja Kumar who has been granted bail vide order dated 06.04.2022 is not similarly situated or identical like the petitioner. Considering the submission made by the learned

Patna High Court CR. MISC. No.40465 of 2022(2) dt.03-08-2022 2/2 A.P.P. for the State, the Court for the present is not inclined to enlarge the petitioner on bail.

In the event, if the trial is not concluded within a period of four months from today for no fault of the petitioner, then the petitioner will be at liberty to renew his prayer for bail before the learned trial court itself.
