ANJANA MISHRA ORAL ORDER 04-07-2016 Heard learned counsel for the petitioner and learned counsel appearing for the State.

The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 341, 323, 325, 379, 504, 307 of the Indian Penal Code in which subsequently Section 302 of the Indian Penal Code is also added.

Learned counsel for the petitioner submits that though the petitioner is named in the FIR, yet there is no specific allegation against the petitioner. It is also submitted that the main allegation of assault is against Rahul Kumar and Pranav Kumar who are said to have assaulted the deceased. Learned counsel for the petitioner further submits that similarly situated co-accused has been extended the privilege of anticipatory bail vide order

Patna High Court Cr.Misc. No.19375 of 2016 (4) dt.04-07-2016 2/2 dated 29.10.2015 passed in Cr. Misc.No. 34180 of 2015. Considering the facts and circumstances of the case and also that the petitioner is not said to have assaulted the deceased and that he has no criminal antecedent, let the above named petitioner in the event of his arrest/surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Darbhanga, Incharge Jamalpur Police Station in Jamalpur P.S.Case No. 68 of 2015,subject to the conditions as laid down u/s 438(2) Cr.P.C.
