The petitioner seeks bail in connection with Bihta P.S. Case No. 679 of 2022, registered for the offence punishable u/s 25(1-b)a, 26, 35 of the Arms Act.

As per the prosecution story, from the house of the petitioner, one country made pistol and four live cartridges were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case due to ulterior motive. The said arms were recovered from the house of the petitioner not in a possession of the petitioner. Petitioner has one criminal antecedent and is in custody since 03.04.2024.

Learned APP for the State opposed the prayer for bail.

Considering the aforesaid facts and circumstances and considering the nature of offence and also considering the criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. The prayer for grant of regular bail on his behalf is hereby rejected.
7. However, the petitioner is at liberty to renew his prayer for bail after framing of charge.
