2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 137(2) of B.N.S.

3. The case of the prosecution is that two minor girls were missing.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that during course of investigation, one of the minor girls has given her statement under Section 183

Patna High Court CR. MISC. No.37805 of 2025(3) dt.02-09-2025 2/3 BNSS wherein she has stated that she was having friendship with this petitioner and she has gone with him and that they have solemnized marriage. In para-96 of the case diary, it has also come that the victim has denied the medical examination. Learned counsel for the petitioner has further submitted that the petitioner has not kidnapped anyone rather he was in friendship with the victim and they have gone on their sweet will. From the statement of the victim recorded under section 183 BNSS, it is clear that she was on talking terms with the petitioner and she was caught by her mother talking with the petitioner. She was being thrashed by her mother. After this, she went on the pretext of purchasing of payal and fled away with the petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 07.09.2024.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ram Krishna Nagar P.S. Case No. 570 of 2024 on furnishing

Patna High Court CR. MISC. No.37805 of 2025(3) dt.02-09-2025 3/3 bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Court No. 15, Patna.
