JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-08-2022 Though the present writ petition has been filed for quashing the order dated 8.1.2018, passed by the District Magistrate, Nawada in Case No. 29(R) 2017 inasmuch as the same has been disposed of without deciding the lis on account of pendency of one title suit bearing Title Suit No.
Patna High Court CWJC No.5802 of 2018(3) dt.29-08-2022 2/2 311/16, which is pending before the learned court of Sub-Judge, Nawada, however, the learned Senior Counsel, Sri Dronacharya, appearing for the private respondents has fairly submitted that there is no order of injunction passed by the learned court below, therefore, in such view of the matter, the learned counsel for the parties are in agreement that the District Magistrate, Nawada can be directed to hear and pass appropriate orders on merits, as far as the aforesaid Case No. 29 (R) 2017 is concerned, after giving an opportunity of hearing to all the interested parties. It is directed accordingly.
The writ petition stands disposed of on the aforesaid terms.
