JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Katra P.S. Case No. 135 of 2023, registered for the offence punishable under Sections 354(A), 448 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent. Learned counsel for the petitioner submits that he has been implicated in this case out of jealousy and lust for petitioner's homestead land. Petitioner is in custody since 23.05.2023.

Learned APP has vehemently opposed the prayer for

Patna High Court CR. MISC. No.38576 of 2023(2) dt.05-07-2023 2/2 bail.

Considering the period of custody, this application is allowed.

Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge-cumSpecial Judge, POCSO-I, Muzaffarpur, in connection with Katra P.S. Case No. 135 of 2023.
