1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Ranitalab Police Station Case No. 481 of 2024, disclosing offences under Sections 80, 238 of the BNS, 2023 and Section 3⁄4 of the Dowry Prohibition Act.
3. As per the prosecution case, daughter of the informant, namely Muskan Kumari, was married to co-accused Rohit Kumar. On 28.12.2024, the informant called her daughter, but she did not pick up her phone. When the informant went to the matrimonial home of her daughter and inquired about her, she came to know that petitioner along with other accused persons have killed her daughter and have concealed her dead body. Patna High Court CR. MISC. No.35562 of 2025(3) dt.03-09-2025 2/3 accused persons used to demand Rs 2 lakhs as dowry and due to non-fulfillment of the demand, she has been killed in her matrimonial home.
4. Learned counsel for the petitioner submits that the petitioner is father-in-law of the deceased and has falsely been implicated in this case with oblique motive. The marriage of the petitioner's son was solemnized with the alleged deceased on 26.04.2024. The deceased was having some love relationship with another boy and on 19.07.2024, i.e., after the marriage of the alleged deceased with the son of the petitioner, she fled away with another boy namely Ranjan Kumar, son of Tuntun Paswan. The informant lodged the FIR against Ranjan Kumar on 22.07.2024, bearing Sirimore PS Case No. 141 of 2024. The dead body of the deceased has not been recovered by the police and according to the petitioner, he has been implicated in false and fabricated case.
5. On the other hand, learned counsel for the state opposes the prayer for anticipatory bail and submits that during course of investigation, sister of the deceased has given statement that when she visited the matrimonial home of the deceased, she was not found in the home.
6. Having regard to the submissions made on

No.35562 of 2025(3) dt.03-09-2025 3/3 behalf of the parties and taking into consideration the fact that prior to the alleged date of occurrence of the present FIR, another FIR was lodged by the same informant stating that on 19.07.2024, one Ranjan Kumar has allured the informant's daughter namely Muskan Kumari (deceased) and fled away with her, I am inclined to grant the petitioner privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Danapur, Patna, in connection with Ranitalab Police Station Case No. 481 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
