JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2015 The petitioner has renewed his prayer for bail in a case registered under Sections 409, 420, 467, 468 of the I.P.C.

Accusation is misappropriating the money under MANREGA and BRGF schemes. During enquiry, the SDO, Bakhri found that in one of the schemes the work order was issued by the petitioner being Panchayat Secretary. It is submitted by learned counsel for the petitioner that work order was issued by the petitioner on the oral order of Panchayat Mukhiya. The enquiry report reflects that Rs. 95,000/- of MANREGA scheme was misappropriated for which Panchayat Rojgar Sewak and Panchayat Mukhiya and others were held responsible though out of Rs. 95,000/- the work of Rs. 81,000/- was found to be done. It is further submitted that Panchayat Mukhiya, Junior Engineer and

Patna High Court Cr.Misc. No.37408 of 2014 (2) dt.18-02-2015 2/2 Assistant Engineer have been granted anticipatory bail by this Court.

Since the petitioner's application for anticipatory bail was disposed off vide order dated 16.10.2012 passed in Cr. Misc. No. 31136 of 2012 and thereafter period of surrender was further extended vide Cr. Misc. No. 14380 of 2013, this Court is not inclined to entertain the present anticipatory application.

Let learned Court below consider regular bail of the petitioner, keeping in view of the fact that co-accused have been granted anticipatory bail by this Court, if the petitioner surrenders within a period of four weeks and pray for regular bail.

Accordingly the application is disposed off in connection with Bakhri P.S. Case No. 47 of 2012, pending in the Court of learned Chief Judicial Magistrate, Begusarai. (Dinesh Kumar Singh, J) Shageer/- U T
