Case No. 107 of 2014 registered under Sections-420, 467, 468, 471, 120(B)/34 of the Indian Penal Code in which, petitioners apprehend their arrest and accordingly, both the above-said petitions are being heard and disposed off by this common order. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. It would appear from contents of the first
Patna High Court Cr.Misc. No.11661 of 2015 (2) dt.26-03-2015 2/2 information report, which has been lodged on the basis of complaint petition that co-accused, Laxman Sah and the informant are full brothers and said co-accused, Laxman Sah executed deed of gift in favour of his wife, Punita Devi in respect of the lands, in question, and after that, the aforesaid Punita Devi executed registered sale deed in favour of petitioner No. 1 of Cr. Misc. No. 12127 of 2015. So far as petitioner No. 2 of Cr. Misc. No. 12127 of 2015 and the petitioner in Cr. Misc. No. 11661 of 2015 are concerned; they identified the execution of the above-said sale deeds.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Ghorasahan P.S. Case No. 107 of 2014 to the satisfaction of Sri Sudhir Sinha, Judicial Magistrate-Ist Class, Sikrahana at Motihari subject to conditions as laid down u/S 438(2) of the Cr. P.C.
