JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Kurtha P.S. Case No. 117 of 2001 registered for the offences punishable under Sections 146, 148, 149, 341, 448, 329, 307, 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

The criminal case was registered on 24.08.2001. The petitioner was apprehended more than 18 years thereafter on 27.12.2019. He was absconding and was declared proclaimed offender by the Court below. It is alleged in the F.I.R. that the miscreants were the members of an outlawed of MCC group.

Patna High Court CR. MISC. No.35307 of 2020(3) dt.19-02-2021 2/2 Be that as it may, considering the fact that the petitioner has been absconding for more than 18 years, I am not inclined to grant the petitioner privilege of regular bail for the present.

This application is accordingly dismissed.

Let the Court below take steps for expeditious conclusion of the trial. If the trial is not concluded within six months from today, the petitioner shall be at liberty to renew his prayer for bail.
