JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506/34 of the Indian Penal Code. The prosecution case is that the petitioners assaulted the informant causing bleeding injury on his chest and when granddaughter of the informant came to rescue then petitioner No.2, Ratan Kumar Mahto, caused bite injury on her chest petitioners No.3 and 4 pushed daughter-in-law of informant on earth while assaulting her. It is further alleged that petitioner No.3, Mungia Devi, snatched silver locket from the neck of daughter-in-law of the informant. Petitioner No.4, Kalpana Devi, entered into the house of informant and took out cash of Rs. 2500/- by breaking the lock of the box.

No.17529 of 2016 (3) dt.03-05-2016 2/2 It is submitted by the learned counsel for the petitioners that the informant has not received any injury and accusation against the petitioners is omnibus and general. Statement to that effect has been made in paragraph 7 of the petition. It is further submitted that for the occurrence dated 12.01.2016 the FIR was registered on 22.01.2016. Statement has been in paragraph 3 of the petition that the petitioners have no criminal antecedent. There is counter version of the occurrence and petitioner No.3 has lodged complaint case No. 47 of 2016 against the informant.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pradeep Kumar, learned JM, 1st class, Madhepura in connection with Bihariganj P.S. Case No. 12 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
