Heard learned counsel for the petitioners and the learned A.P.P. for the State in both the applications. The petitioners seek bail in a case registered for the

Patna High Court CR. MISC. No.47234 of 2021(4) dt.05-05-2022 2/3 offence under Sections 363,366(A),376 of the Indian Penal Code and Section 4 of POCSO Act.

The prosecution case as alleged in the written report of the informant in short is that on 01.09.2019 at about 4.00 A.M. the victim aged about 16 years alongwith her mother went to attend the call of nature in the meantime co-accused Sujit Bind came on a motorcycle and forcibly took away the victim for the purpose of marriage. It is further alleged that the mother of the victim raised alarm then the informant and the villagers arrived and they chased the accused and the victim but they were not found. It is further alleged that the accused enticed away the minor victim for the purpose of marriage and the co-accused Sujit Bind was already married. Learned counsel appearing for the petitioners submits that petitioners have clean antecedent. They have falsely been implicated in the present case.

Vide order dated 22.03.2022 a report was called for with regard to the stage of the Trial. Report reveals that all the prosecution witnesses have been examined except the I.O. Learned A.P.P. for the State has opposed the prayer for bail of the petitioners.

Considering the aforesaid facts, I am not inclined to

No.47234 of 2021(4) dt.05-05-2022 3/3 enlarge the petitioners on bail in connection with POCSO Case No.44 of 2021 arising out of Parasbigha P.S.Case No.197 of 2019 pending in the court of learned Additional Sessions JudgeVI-cum-Special Court, POCSO, Jehanabad. Prayer is refused.

However, the learned Trial Court is directed to expedite the trial.
