2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 431, 438, 427, 307 of the Indian Penal Code.
3. As per the prosecution case, while the informant was going to Madhepura after loading sand on his truck bearing no. BR11S2284 and when he reached near Chutia More, then he saw that the road was blocked by 500-700 persons on account of an accident in which a school girl died on the spot due to dashing by a truck. Thereafter, some of the protesters, poured diesel on the truck of the informant and set it on fire.
4. It is submitted that petitioner is not named in the FIR. Name of petitioner transpired during course of
Patna High Court CR. MISC. No.40199 of 2023(2) dt.01-08-2023 2/2 investigation. There is general and omnibus allegation and no specific overt act has been alleged against this petitioner.
5. Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 203 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
