The petitioner seeks bail in Ujiyarpur P.S. Case No. 207/2018, instituted for offence under Section(s) 307/34 of the Indian Penal Code read with Section 27 of Arms Act. It is alleged in the written report that while informant was sleeping in the house at night, petitioner along with other accused persons caused firearm injury in his stomach. Hearing the sound of firing brother of informant raised alarm from roof. Thereafter accused persons fled away on motorcycle. Learned counsel for the petitioner has submitted that there is no allegation of causing firearm injury against this petitioner. He is only alleged to be seen running away from the

The other co-accused with similar allegation has already been granted bail by a Co-ordinate Bench of this Court vide order dated 05.07.2019 passed in Cr. Misc. No. 41164/2019.

Petitioner is in custody since 31.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dalsingsarai, Samastipur, in connection with Ujiyarpur P.S.
