The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506 and 379/34 of the Indian Penal Code.
It is alleged that the petitioner no. 1 Munna Prasad caused injury with knife on the head of the informant whereas petitioner no. 2 Santosh Kumar snatched gold chain and cash Rs. 10,000/- from the pocket of the informant.
It is submitted by learned counsel for the petitioners that injury of the informant has been found to be simple in nature. A statement has been made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent.
Considering the nature of accusation, let
Patna High Court Cr.Misc. No.12703 of 2015 (2) dt.26-03-2015 2 / 2 the learned court below consider the prayer for regular bail of petitioner no. 1 Munna Prasad, if he surrenders within a period of six weeks from the date of receipt/production of copy of the order in connection with Motihari Muffasil P.S. Case No. 448 of 2013, G.R. Case No. 5653 of 2013, pending in the court of the learned C.J.M. East Champaran at Motihari.
With this observation, the application of petitioner no. 1 is disposed off.
So far petitioner no. 2 Santosh Kumar is concerned, there is no accusation of making assault against him, let him except petitioner no. 1 be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Motihari Muffasil P.S. Case No. 448 of 2013, G.R. Case No. 5653 of 2013 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
