ANJANA MISHRA ORAL ORDER 30-06-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Magadh University P.S. case no. 16/2016 for allegedly having committed the offence under Sections 147, 149, 341, 427, 353, 511 of Indian Penal Code.
Learned counsel for the petitioner submits that there was some discrepancies in the conduct of examination and some students were trying to lock out the office of the college and create disturbances in the work of the University. It is further submitted that the examination being conducted was of physiotherapy and the petitioner was not the student of the said subject but was present at the place of occurrence with the oblique
Patna High Court Cr.Misc. No.17677 of 2016 (3) dt.30-06-2016 2/2 motive of disturbing the examination. Counsel for the petitioner further submits that no overt act has been attributed to the present petitioner and he is a good student and his career would be affected, if he is taken into custody.
Considering the entire facts and circumstances of the case and that there is no clear allegation against the present petitioner, let the petitioner abovenamed, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Gaya in connection with Magadh University P.S. case no. 16 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J.) rinkee/- U T
