The petitioner seeks bail in connection with a case registered for the offence punishable u/s 366(A) and 363/34 of the IPC.

As per the prosecution case, the petitioner along with other co-accused persons kidnapped the daughter of the informant. 4.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to enmity. There is general and omnibus allegation against the petitioner. There is no specific overt act against the petitioner. The occurrence took place on 24.01.2017 but the FIR
Patna High Court CR. MISC. No.40283 of 2024(2) dt.31-07-2024 2/2 was lodged on 28.01.20217 i.e. after a delay of four days without giving any plausible explanation. He further submitted that the specific allegation is against the co-accused Raj Kumar. The petitioner has no criminal antecedent and has been in judicial custody since 04.03.2024.

Learned APP for the State opposed the prayer for bail by submitting that the victim has supported the prosecution case in her statement recorded u/s 164 of Cr.P.C. and was a minor at the time of occurrence.

Considering the facts and circumstances of this case and the period of custody, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Kurhani P.S. Case No.44 of 2017.
