2. The petitioner seeks bail in connection with Nawada P.S. Case No. 334 of 2024 instituted for the offences under Sections 323, 341, 307, 504, 34, 201, 326 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the accused persons shot at the informant's son, due to which he sustained injuries.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner transpired in this case on the basis of statement made by victim Utkarsh Anand which was recorded after a lapse of five days of
Patna High Court CR. MISC. No.37660 of 2025(3) dt.20-08-2025 2/3 the incident. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. The specific allegation is against co-accused Gajendra Rai. Learned counsel further submitted that as per the injury report, the informant's son sustained two bullet injuries on his chest and even as per the allegation alleged in the FIR, co-accused Gajendra Rai shot the informant's son on his chest. Learned counsel further submitted that, as a matter of fact, the petitioner is nowhere connected with the alleged incident. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.03.2025 and has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, there being no direct material against the petitioner and charge-sheet already being submitted as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of
Patna High Court CR. MISC. No.37660 of 2025(3) dt.20-08-2025 3/3 the like amount each to the satisfaction of Court below/concerned Court in connection with Nawada P.S. Case No. 334 of 2024.
