JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-10-2022 The present petition has been filed seeking the following relief :- "(i) For issuance of a writ in the nature of an appropriate writ(s), order(s), direction in the nature of mandamus directing the respondents to remove the encroachments made over the 8 feet and 6 feet (western side) Municipal P.C.C. road appertaining to Khata no. 244, Khesra no. 530, situated at Noongola, PO&PS-Hajipur, Dist-Vaishali, whereby and whereunder the Anchal Amin

Patna High Court CWJC No.14921 of 2021(2) dt.21-10-2022 2/2 has also found encroachments over the abovementioned Municipal PCC road 8 feet and 6 feet PCC road in his measurement report dated 10.03.2020 submitted before the Circle Officer, Hajipur. "

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Hajipur for redressal of his aforesaid grievance. Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Hajipur by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
