JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504 and 506/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The accusation is of abusing the informant by calling caste name and making assault.

It is submitted by learned counsel for the petitioners that for the occurrence of 08.04.2014, the complaint was filed on 16.04.2014 which came to be registered as a police case on 01.06.2014 and admittedly the occurrence took place inside the house of the informant which cannot be treated to be a place of public view. A statement has been made in para 3 of the petition

Patna High Court Cr.Misc. No.13024 of 2015 (2) dt.06-05-2015 2/2 that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Siwan SC/ST P.S. Case No. 57 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
