The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 342, 323, 324, 325, 379, 354, 307 and 504 of the Indian Penal Code.
The prosecution case is that the accused persons made criminal trespass in the house of the informant, assaulted the informant, his uncle others. They also took away the valuable articles from the house.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.17480 of 2016 (2) dt.25-04-2016 2/2 petitioners that the accusation is omnibus and general. The petitioners have no criminal antecedent but injuries of the informant and other injured have been found to be grievous which gets reflected from the impugned order and it is admitted by learned counsel for the petitioners also. Though, Upendra Yadav, Bilash Yadav and Bigan Yadav have been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 49052 pf 2015 where it was submitted that the injuries have been found to be simple in nature.
In the circumstances, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Wazirganj P.S. Case No. 158 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Gaya.
