2. Heard Mr. Krishna Pd. Singh, learned Senior Counsel for the petitioners, learned APP for the State and learned counsel for the informant.

3. The petitioners apprehend arrest in connection with Dehri (Town) P.S. Case No. 443 of 2023 instituted under Sections 304(B)/34of the Indian Penal Code.

4. As per the prosecution case, earlier the family members i.e. the younger brother of petitioner no. 1 had misbehaved with the deceased and an FIR was registered by the deceased against the younger brother of petitioner no. 1. The petitioners were not made accused. Thereafter, the deceased has died by burn injury.

5. Learned Senior Counsel for the petitioners submits

Patna High Court CR. MISC. No.48773 of 2024(3) dt.29-11-2024 2/2 that the petitioners are innocent and have committed no offence. There is general and omnibus allegation against all the family members that they have killed the deceased by pouring kerosene oil. The petitioners are the elder brother-in-law (bhaisur) and sister-in-law of the deceased.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the fact that the petitioners are the brother-in-law and the sister-in-law of the deceased and there is general and omnibus allegation against them as also the fact that just few days before the occurrence, the petitioners were not made accused, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri, Rohtas in Dehri (Town) P.S. Case No. 443 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
