Petitioner apprehends his arrest in connection with Chhatapur P. S. case no. 247/2014 registered under sections 302, 201/34 of the Indian Penal Code.
Petitioner is not named in the first information report nor in the further statement of the informant as well as in the statements of her family members but para 36 of the case diary reveals that name of this petitioner surfaced in the supervision note of Dy. S.P, Triveniganj and thereafter, some witnesses made parrot like statement naming the petitioner in the alleged crime.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let
Patna High Court Cr.Misc. No.12224 of 2015 (3) dt.01-05-2015 the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Supaul in Chhatapur P. S. case no. 247/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
