JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447,448,147,341,327,504,506,384 and 380 of the Indian Penal Code.
It is alleged that the accused petitioners came variously armed on the door of the informant and demanded ten thousand as extortion for allowing the informant to run Anganbari Centre. It is further alleged that the informant was abused and articles from his house were taken away.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.7752 of 2015 (2) dt.26-02-2015 2/2 that petitioners are agnates of the informant and due to bonafide land dispute the accusation has been levelled. Statements to that effect have been made in paragraphs 7 and 8 of the petition. Statement has also been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Bahera P.S. Case No. 488 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
