The Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 379/34 of the Indian Penal Code.

The prosecution case is that two miscreants stolen the motorcycle of the informant containing mobile, driving license and voter I.D. Card and F.I.R. leading to registration of F.I.R. against unknown. Subsequently on the confessional statement of co-accused Ajit Kumar Pandey, the name of the petitioners sprang up as one of the miscreants who participate in commission of the offence.

No.19231 of 2016 (4) dt.28-06-2016 2/2 It is submitted by the learned counsel for the petitioners that there is no recovery from the possession of the petitioners and the petitioners are accused in one another case. It appears that on confession of the co-accused, Ajit Kumar Pandey who named the petitioners, the alleged motorcycle was recovered. The aforesaid facts may constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners and preferably disposed of the same on the same day, if the petitioners surrender within a period of six weeks in connection with Kalyanpur P.S. Case No. 113 of 2015, pending before the Court of Chief Judicial Magistrate, Motihari, East Champaran.

With the above observation, this application is, accordingly, disposed off.
