JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-05-2015 Heard learned counsels for the petitioner and the State. The petitioner being the brother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 341/323/498A/504/506/304B/120B/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. It is alleged that the daughter of the informant was killed after one year of marriage for non-fulfillment of dowry demand.
Learned counsel for the petitioner submits that victim was pregnant and suffering from some pregnancy complications for which she was provided medical assistance but in spite of best effort the victim could not be saved. It is further submitted that the informant has admitted in the complaint petition that the victim died in his presence while she was undergoing treatment
Patna High Court Cr.Misc. No.14078 of 2015 (2) dt.08-05-2015 2/2 and considering the aforesaid facts the husband of the victim has been granted anticipatory bail by a co-ordinate bench of this Court vide Criminal Miscellaneous No.4575 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharasa in connection with Nauhatta P.S. Case No. 108 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
