JUSTICE HEMANT GUPTA ORAL JUDGMENT Date: 04-10-2016 The petitioner has invoked the writ jurisdiction of this Court to ensure the recovery of the son of the petitioner, who is traceless since 03.08.2015, for which Shikarpur P. S. Case No. 509 of 2015 has been registered for the offences under Sections 364, 302, 201, 120B and 34 of the Indian Penal Code.

The petitioner has sought a direction to the respondents to immediately arrest the accused persons who are threatening the petitioner to withdraw the said case.

In the counter affidavit filed on behalf of the respondent no. 5, the stand is that investigation is continuing, but no

Since the investigation is under process, therefore, no further direction is called for. What is the stage to arrest the accused persons has to be decided by the Investigating Officer. Therefore, no further direction can be issued to conduct investigation in a particular manner except to direct the respondents to conclude the investigation expeditiously.
