JUSTICE SANJAY PRIYA ORAL ORDER 5/ 01-11-2017 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Informant. Petitioner apprehends his arrest in Kasba P.S. Case No.48 of 2017 instituted for the offence under Section(s) 302, 201, 120-B/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Purnea.

Counsel for the Petitioner has submitted that mere suspicion has been raised against the petitioner. There is specific allegation against co-accused Md. Alim. Name of this petitioner has been disclosed by co-accused in his confessional statement. Counsel for the Informant has appeared and submitted that regular bail application of one of co-accused, Md. Rahul, has been dismissed by a co-ordinate Bench of this Court by order dated 03.10.2017 passed in Cr. Misc. No.38349 of 2017.
