The learned counsel appearing for the B.S.F.C., at the outset, submits that the petitioner instead of approaching this Court ought to have moved before the Committee constituted in terms of order dated 06.08.2018 in L.P.A. No. 881 of 2016. The learned counsel for the petitioner, at this stage,
Patna High Court CWJC No.18381 of 2018(2) dt.12-04-2023 2/2 does not object to the submission made by the learned counsel for the B.S.F.C. and submits that petitioner would be satisfied if he is relegated before the committee constituted in terms of the aforesaid order.
The learned counsel for the State also does not object to the submission made by the learned counsel for the petitioner. In view of the submissions made by the learned counsel for the parties, the writ application is disposed of with a direction to the petitioner to approach before the committee constituted in terms of the order dated 06.08.2018 in L.P.A. No. 881 of 2016.
In the event, if petitioner represents before the committee in terms of the order dated 06.08.2018 in L.P.A. No. 881 of 2016 by 01.05.2023, the committee shall consider and dispose of the representation of the petitioner expeditiously, preferably within a period of three months from the date of receipt/production of a copy of the representation.
