2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bheja P.S. Case no. 28 of 2019 instituted for the offence under Sections 363, 366A/34 of the Indian Penal Code.

3. Allegation against the petitioner is that he along with co-accused persons abducted the daughter of the informant when she went to attend nature's call.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. There is no specific allegation of abduction against the petitioner rather the same is attributed against co-accused Sonu Singh and Shankar Kumar and co-accused Sonu Singh has already been

Patna High Court CR. MISC. No.41497 of 2024(2) dt.20-06-2024 2/2 enlarged on bail granted by this Court vide order dt. 4.5.2023 passed in Cr. Misc. No. 2890 of 2023. It is also submitted that after investigation, the police have submitted final form against the petitioner submitted charge-sheet against others and the petitioner was not sent up for trial.

5. Learned APP appearing for the state has opposed the prayer of bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Bheja P.S. Case no. 28 of 2019, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Jhanjharpur, Madhubani subject to the conditions as laid down under section 438(2) of the Cr.P.C.
