The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

It is a case of hatching conspiracy of looting Bandhan Bank and also a businessman of Mahnar by the accused persons but the police arrested two persons, namely, Priyanshu Kumar with a pistol and Raushan Kumar with a live bullet and others fled away.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has not been apprehended at the

Patna High Court CR. MISC. No.47551 of 2021(2) dt.24-03-2022 2/2 spot. He further submits that the name of the petitioner has transpired from the confessional statement of co-accused Priyanshu Kumar, who was apprehended at the spot and nothing has been recovered from the conscious or constructive possession of the petitioner. Petitioner has got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 255 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
