The petitioner renews his prayer for regular bail in connection with Araria (R.S.) PS Case No. 102 / 2021 registered under Section 25 (1) (a)(1)(A), 1 (B) (a) / 26 / 35 of the Arms Act inasmuch as earlier the bail application of the petitioner was dismissed as withdrawn vide Cr. Misc. No. 48207 / 2021 by this Court with liberty to the petitioner to renew his prayer for bail after three months.
One country made pistol and a knife have allegedly been recovered by the Police from the possession of the petitioner.
Learned counsel for the petitioner submits that the petitioner is in custody since 31-01-2021 i.e. for more than 1
Patna High Court CR. MISC. No.39134 of 2022(2) dt.03-08-2022 2/2 year 6 months and the petitioner is having no criminal antecedent of similar nature of offence. He further submits that since the date of last rejection of the prayer for bail by this court the trial has not registered any progress.
Having regard to the submissions made by the parties and taking into consideration the fact that petitioner is in custody since 31 / 01 / 2021 , this is second attempt for bail on behalf of the petitioner and there is no likelihood that the trial will conclude in near future, and as such, I am inclined to grant regular bail to the petitioner.
Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- ( twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Araria in connection with Araria (R.S.) PS Case No. 102 / 2021.
