The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364, 120B/34 of the Indian Penal Code subsequently sections 302, 201 IPC were also added.
Prosecution case is that on 14.04.2015, the husband of the informant namely Chamaklal Chaudhary went towards Laxmipur but on the way co-accused Manoj Kumar Mehta kidnapped her husband. The FIR was lodged against Manoj Mehta and four unknown. The name of the petitioner sprang up on the confession of Manoj Kumar Mehta. From the impugned order it appears that the petitioner was seen by several witnesses in the company of the informant's husband while travelling in a
Patna High Court Cr.Misc. No.18777 of 2016 (2) dt.02-05-2016 2/2 white colour vehicle.
It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Srinagar P.S. Case No.21/2015, pending before the learned Judicial Magistrate, 1st Class, Madhepura.
With the above observation, this application is, accordingly, disposed off.
