The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 47(a) (f) of the Excise Act.

240 kgs. of Modak was recovered though the same was not seized actually.

It is submitted by learned counsel for the petitioner that admittedly there is no seizure from the petitioner. Moreover, the petitioner was a licensee and license was valid up to 2010 and for the renewal of the license the required fee has already been submitted. The police earlier filed case under

Patna High Court Cr.Misc. No.7785 of 2015 (02) dt.26-02-2015 2/2 NDPS Act in which petitioner has been granted bail vide Cr. Misc. 31085 of 2014.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Official Complaint Case No. (0) 02 of 2015 pending in the court of learned Chief Judicial Magistrate, Buxar.

With the aforesaid observation, this application is disposed of.
