The prayer for anticipatory bail of the petitioners was earlier withdrawn which was noticed in the order dated 27.07.2022, when the petitioners were granted provisional bail and case diary was called for.

The petitioners are brother and father of one Kishore Ram who is alleged to have taken away the 15 years old daughter of the Informant for the purposes of marriage. The learned counsel for the petitioners submits that Kishore Ram, who is the brother and son of the petitioner nos.1 and 2 respectively, has been arrested and his regular bail

Patna High Court CR. MISC. No.39017 of 2022(3) dt.21-09-2022 2/2 application is pending before this Court.

However, it has additionally been submitted that in the medical examination of the so-called victim, she has been found to be of 19 to 20 years of age. She has also disclosed her intention of marrying the son of the petitioner no.2 and till the time the marriage is performed, she is residing with the petitioners.

Nothing different has been found in the investigation papers.

Considering the aforestated facts, the provisional bail granted to the petitioners is hereby confirmed. The petitioners shall remain on the same bail bonds.

The petition stands allowed.
