2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) and 30(c) of Bihar Prohibition & Excise Act, 2018.
3. There is recovery of 5.500 liters of country made liquor and some utensils for manufacturing liquor from a hut.
4. Learned counsel for the petitioner submits that the petitioner has nothing to do with the seized liquor and the said hut was situated far from the house of the petitioner and was being illegally used by someone else for manufacturing liquor. It has further been submitted that no recovery was made from personal or conscious possession and there was no

5. Learned APP for the State opposed the bail petition.
6. Taking into consideration the facts and circumstances of the case and also considering the fact that mandatory provisions of search and seizure have been violated and the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court, Sheikhpura/concerned Court below in connection with Excise P.S.
