JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code.
It is alleged that the petitioner being Headmistress of the school issued two School Transfer Certificates in favour of Pappu Kumar and Sunil Kumar Keshari which were found forged. It is submitted by the learned counsel for the petitioner that on the alleged date 400 School Transfer Certificates were issued but on verification by an Assistant Teacher it was found that two certificates were recently issued but they were cancelled on the very next day on 9.6.2015. The alleged two certificates have never been used by two persons namely Pappu and Sunil. Statement to that effect has been made in paragraph 10 of the
Patna High Court Cr.Misc. No.18199 of 2016 (2) dt.27-04-2016 2/2 petition. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the School Transfer Certificates were cancelled on the very next day of their issuance and the petitioner is lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bikramganj, in connection with Dinara P.S. Case No. 50 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
