Mr. Jitendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RITESH KUMAR ORAL ORDER 28-07-2026 Heard the learned counsel for the petitioners and the learned A.P.P. appearing on behalf of the State.

2. The petitioners apprehend their arrest in connection with Majhauliya P.S. Case No.713 of 2025 for allegedly having committed offences under Sections 112(2), 115(2), 118(1), 110, 303(2), 352 and 3(5) of the B.N.S.

As per the prosecution story, which has been lodged on the basis of the written report submitted by the informant, to the effect that while he was cleaning his purchased land, all the accused persons, including the petitioners herein arrived there on account of a long standing dispute in between the parties. The

2/4 accused persons were armed with stick and farsa and told the informant to vacate the land, which was objected by him whereupon on the orders given by the petitioner no.1, co-accused, Karan Singh @ Bhola Singh assaulted the informant on his head with a farsa, due to which he sustained injuries and fell down on the ground. Thereafter Prince Singh (petitioner no.3) assaulted him with lathi, due to which the informant sustained injuries on different parts of the body. It has further been alleged that coaccused, Karan Singh and Prince Singh (petitioner no.3) also snatched gold ornaments from him and when the villagers arrived at the place of occurrence, all the accused persons fled away.

4. The learned counsel for the petitioners submits that the allegations levelled in the First Information Report are false and fabricated and no such occurrence has taken place. He submits that admittedly there is a land dispute, which appears from the statement made in the First Information Report. So far the allegation part is concerned, the specific allegation of assault on the head of the informant with a farsa has been levelled against coaccused, Karan Singh and Prince Singh (petitioner no.3) is said to have assaulted the informant on different parts of his body. Praduman Singh (petitioner no.1) is only the order giver. He further submits that the injuries, if any on the head, has been caused due to assault by co-accused, Karan Singh. He submits that

3/4 so far the petitioners no.1 and 3 are concerned, they have got one criminal antecedent. So far the petitioner no.2 is concerned, he has got a clean antecedent.

Per contra, the learned A.P.P. for the State opposes the prayer for grant of anticipatory bail to the petitioners and submits that there is specific allegation of assault on the head of the informant against co-accused, Karan Singh and so far the petitioner no.3 is concerned, he has assaulted on the body part of the informant, due to which he sustained multiple injuries.

Having considered the rival submissions and after going through the records, it appears that the allegation against the petitioner no.1 is that he ordered the co-accused persons, including the petitioner no.3 to kill the informant and apart from the same no other allegation has been levelled in the First Information Report. So far the petitioner no.2 is concerned, no specific allegation of any assault has been levelled against him and so far the petitioner no.3 is concerned, an allegation of assault on diffetrent parts of the body of the informant with stick has been levelled against him. From the injury report, which has been recorded in the impugned order dated 27.04.2026 passed by the learned District & Additional Sessions Judge-II, Bettiah, West Champaran, it would transpire that abrasion and bruise are there on the body part of the informant, apart from one injury on head, however the same has

4/4 been attributed on co-accused, Karan Singh.

Taking into consideration the facts aforesaid, let the petitioners, above-named, in the event of their arrest or surrender within a period of six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah in connection with Majhauliya P.S. Case No.713 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S. with a further condition that:- The learned court concerned shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court concerned shall take steps for cancellation of their bail bonds. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
