1. Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Udakishunganj P.S. Case No. 85 of 2023 registered for the offence under Sections 8( c)/21(A) of the N.D.P.S. Act.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 24.03.2023 and it is alleged that 2 grams of smack was recovered.

4. Learned A.P.P. has vehemently opposed the prayer for bail.

5. The recovery is of small quantity and the petitioner is in custody since 24.03.2023 having no criminal antecedent.

6. Considering the period of custody and the

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-1st-cum-Special Judge, Madhepura/ concerned Court below in connection with Udaikishunganj P.S. Case No. 85/2023.
