Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Palanwa P.S.Case No. 35/2001, registered for the offences punishable under Sections 304(B)/201/34 of the Indian Penal Code.
It is submitted on behalf of the petitioners that the present
Patna High Court Cr.Misc. No.40033 of 2014 (2) dt.25-03-2015 2/2 case was registered in the year 2001 and charge-sheet was submitted against the husband and father-in-law of the deceased lady and they have been acquitted by a judgment passed by this Hon'ble Court. Learned counsel for the petitioner further submits that in the year 2011, all of a sudden the petitioners came to know that they are also implicated in the present case. He further submits that they have been falsely implicated in the present case and final form has been submitted, vide Annexure 2 , in the year 2003 but cognizance was taken by the court in the year 2011. Considering the aforesaid submissions and also the fact that the main accused have been acquitted on 27.10.2005 in Cr. Appeal (SJ) No. 261 of 2003, let the petitioners nos.
1 to 3, named above, in the event of their arrest or surrender before the court below within two weeks from the date of receipt/ production of a copy of this order, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Kamla Prasad, learned Judicial Magistrate, 1st Class, Raxaul at Motihari, in Palanwa P.S. Case No. 35/2001 (T.R.No. 59/2014), subject to the conditions as laid down u/s 438(2) Cr.P.C.
